    Site Rules Change : Copyright

    After a thread on the site today and a discussion about the use of third party images to composite into a photo and create a resultant image, the mods and I discussed the need for a rule change.

    We feel that if members are going to use 'stock' or similar photos to use in combination with their own photo to create what is essentially a new and third image, that this should be disclosed at the time of posting.

    For Example if you say get a royalty free/stock image off the internet and take the sky from that photo and use it to replace the sky in your own photo, or, you get an old vintage car from a royalty free/stock site and place it in your rural road scene, then you need to disclose that at the time of posting your photo.

    Note

    * Competition entries cannot contain these 'elements' sourced from elsewhere.
    * Use of copyrighted work, that is not your own, is not allowed anywhere on Ausphotography

    Thus we have amended Ausphotography Site Rule 20 to now state:
    [20] Any photograph a member presents on Ausphotography, whether by uploading to the site or displayed directly within the site using the IMG tags must be copyright owned by the member. Breaching copyright is a serious matter with legal implications and could result in an immediate and permanent ban from Ausphotography. Links directing members to other sites, where third-party owned item(s) are displayed, is allowed. If you are linking to a third party's Art (photo etc) for critique/review/opinion, under the Australian copyright act you must acknowledge the author and title of the work, in your post/thread.

    If any elements of the photo are not copyright to the member, this must be disclosed at the time of posting. Any element added must be copyright free. This applies to using ‘stock’ elements, or similar, in a photo. Failure to disclose that your photograph includes elements that are not your own original work will be deemed to be a copyright breach. Competition entries cannot contain elements not created by the competition entrant.

    Use of the Free Site Gallery is based on participation in other areas of the site. Using the Site Gallery as a free hosting service and not being a regular active contributor to the forums etc, could see your membership restricted or cancelled.

    The orange second paragraph, above is the rule addition.

    Please abide by this rule, and if you do use a non-copyright third-party element in your photo(s), disclose it at the time of posting.

    (I was trying to write something about the sordidity that this refers to but found it hard not to express some strong denigration, so this will do.)

    It's very simple:

    If you put up an image for CC and have added 3rd party elements, that's fine as long as its disclosed and your have not breached ©

    If you got out and take a bunch of sky shots for combining with other of your images - that is fine as well and can also be entered into competitions as its 100% your work.

    I do not believe the member did it with any malice intended at all. But it exposed an issue that we needed to resolve on the site, and have done so with the clarification in the rules.
